Acceptance of these terms

These Terms of Use govern your access to and use of gtitransport.us (the “site”), operated by GTI Transport LLC (“GTI Transport,” “we,” “us”). By using the site you agree to these terms. If you do not agree, please do not use the site. You must be at least 18 years old and able to enter into a contract to use this site.

What this site is

This site describes GTI Transport and the open-deck trucking services we offer, flatbed, step-deck, hazmat, regular full truckloads and partial loads, and lets you request a quote or apply to drive. We work to keep the information accurate and the site available, but we do not guarantee that it is complete, current or uninterrupted, and we may change or withdraw any part of it at any time.

Quotes, rates and how a booking is formed

Rates, capacity, transit times and other figures shown on this site or given in response to an enquiry are estimates for information only and are not an offer capable of acceptance. They depend on the details you give us and on conditions at the time of shipment.

No shipment is booked, and no contract of carriage exists, until we confirm it with you in writing. Where we do, the shipment is governed by the signed rate confirmation, the bill of lading, and any separate transportation agreement between us, not by this website. If anything on this site conflicts with those documents, those documents control.

Cargo liability and claims

For interstate shipments we handle as a motor carrier, our liability for cargo loss or damage is governed by the Carmack Amendment (49 U.S.C. § 14706), by the bill of lading, and by any applicable transportation agreement, including any agreed limits of liability, filing deadlines and claim procedures. Nothing on this website enlarges, waives or alters those rights and obligations for either side. Certificates of insurance are available on request, and our authority and insurance filings are a matter of public record with the FMCSA under USDOT 2914256 and MC 982312.

Acceptable use

You agree not to:

• Use the site for any unlawful purpose, or in breach of these terms.
• Submit false, misleading or fraudulent information, including in a quote request or a driver application.
• Attempt to gain unauthorised access to the site, its servers, or any connected system.
• Interfere with the site’s operation, including by introducing malicious code or by overloading it.
• Scrape, harvest or systematically extract content or contact details for bulk marketing.

Information you send us

You are responsible for the accuracy of what you send us, including freight dimensions, weight, commodity and any hazardous materials classification. Inaccurate information can make a shipment unsafe, unlawful or impossible to perform as quoted, and may change the price. You confirm you have the right to give us any information you submit, and you grant us permission to use it in order to respond to you and perform the services requested.

Driver applications

Applying through this site is an expression of interest and does not create an employment or contractor relationship, or any promise of work. Pay figures, bonuses and dispatch-fee tiers shown on the site are current published terms, may change, and are subject to the agreement you sign with us and to the requirements being met. Background, motor vehicle record and testing checks are carried out as federal regulation requires and with the authorisations those rules demand.

Intellectual property

The content of this site (text, photographs, logos, graphics, layout and design) is owned by GTI Transport LLC or used with permission, and is protected by copyright, trademark and other laws. You may view and print pages for your own reference or internal business use. You may not copy, republish, sell or reuse any part of it commercially without our written permission. The GTI Transport name and logo are our trademarks and may not be used without permission. If you believe material on this site infringes your copyright, contact us with the details and we will investigate promptly.

Links to other sites

This site links to third-party websites, including our social media pages and public regulatory records. We provide those links for convenience, we do not control those sites, and we are not responsible for their content, accuracy or practices.

Disclaimers

The site and its content are provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Information on the site is general and is not legal, regulatory, safety or compliance advice for your particular shipment.

Limitation of liability

To the fullest extent permitted by law, GTI Transport LLC and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or business, arising out of or relating to your use of this site, even if we have been advised that such damages are possible. To the fullest extent permitted by law, our total liability arising out of your use of this site will not exceed one hundred US dollars ($100).

These limits apply to your use of the website. They do not limit our liability for cargo loss or damage under a contract of carriage, which is governed by the Carmack Amendment and the shipping documents as described above, and they do not exclude any liability that cannot lawfully be excluded.

Indemnification

You agree to indemnify and hold harmless GTI Transport LLC and its owners, employees and agents from any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of your misuse of the site, your breach of these terms, or information you submit that is inaccurate or that you had no right to provide.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and, where applicable, by federal transportation law. If a dispute arises, we ask that you contact us first so we can try to resolve it informally. Most issues are settled that way. If that does not work, you agree that the state and federal courts located in Travis County, Texas have exclusive jurisdiction, and you consent to venue there. This clause governs disputes about the website; disputes about a shipment are governed by the bill of lading, the rate confirmation or the transportation agreement, which may specify a different process.

General terms

If any provision of these terms is held unenforceable, the rest remain in force and the unenforceable provision will be applied as closely as possible to its original intent. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor of our business. These terms, together with our Privacy Policy, are the entire agreement between us about your use of this site. We are not liable for failures caused by events beyond our reasonable control.

Accessibility

We want this site to be usable by everyone. It is built to follow recognised accessibility practice, including keyboard navigation, visible focus states, descriptive alternative text and readable colour contrast.
